The Dos and Don’ts of Arrest
Many people have interacted with cops very little, or simply get nervous when they talk with them. Especially for such individuals, it is important to be aware of what behaviors will help and hurt you the most if you are arrested. Consider the following suggestions of “dos” and “don’ts”
DON’T: Answer (most) questions from police. Especially if you are nervous, used to appeasing authorities, or angered over the injustice of your arrest, it can be tempting to try to convince the police officers that they have it all wrong. However, you absolutely cannot know what will hurt or help you at this point in the case, so it is essential not to speak at this point.
DO: Give police your name, phone number, and address. Usually it is required that you answer these questions.
DO: Ask for a criminal defense attorney. Along with not speaking, this is the most important thing you can do.
DON’T: Run, resist, or otherwise evade arrest. This simply adds charges on top of the ones you are already facing. Even if you are found completely innocent of the charges that made officers pursue you, you could still be tried and convicted for evading arrest.
DON’T: Be rude or disrespectful to police. This will only hurt your case.
DO: Ask for badge numbers of any police officers you believe mistreat you.
DON’T: Believe everything police tell you. They are legally allowed to lie to you, and may tell outrageous untruths to try to get you to say what they want.
